2. Purpose and scope

These terms and conditions of sale ("Terms") govern orders for digital programs and support services placed on the Forme & Nutrition website.

The offers are reserved for individuals aged at least 18 with the necessary legal capacity, purchasing for their personal needs as consumers.

The site content, communications and contract are governed by these Terms; where a customer corresponds in English, Forme & Nutrition communicates with them in English, with the French version remaining the legal reference in case of interpretation dispute.

The Terms are accessible before ordering and can be saved or printed. The customer must accept them before confirming an order.

The applicable terms are those accepted on the order date. The specific characteristics of the chosen offer, presented before purchase and repeated in the order confirmation, supplement these Terms. In case of contradiction, the expressly accepted specific conditions prevail, subject to mandatory legal provisions.

3. Offers

Forme & Nutrition offers the following, subject to availability on the site:

OfferMain contentPrice
Ready-made programPre-designed digital program, not individualized€9.90
Personalized Sport programPersonalized sport program and 30 days of follow-up€39.90
Personalized Nutrition programPersonalized nutrition program and 30 days of follow-up, within the limits set out in Article 4€39.90
Forme & Nutrition PackPersonalized sport and nutrition programs, with 30 days of follow-up€59.90
Extended supportMonthly follow-up subscribed separately after the initial support period€19.90/month

Each offer's page sets out, before purchase, its content, objectives, prerequisites, any equipment needed, included services and any restrictions.

Ready-made programs do not include personalized follow-up, unless expressly stated in the offer purchased.

The suggested usage period of a sport or nutrition program is not the same as the PDF access period.

No physical product is shipped.

4. Nature and limits of the support provided

Sport services are provided within the qualifications and professional prerogatives of the sport coach.

Nutrition-related content has an educational and lifestyle-support purpose. It does not include any medical diagnosis, treatment, medical prescription, or therapeutic dietary care. It does not replace a consultation with a doctor or other qualified healthcare professional.

Personalization cannot cover acts reserved to a regulated profession for which the Trader does not hold the necessary qualification.

Where a request falls outside the Trader's field of competence or requires healthcare, the customer is directed to a qualified professional. If the purchased service cannot be carried out in this context, the Trader informs the customer and refunds the unperformed part. Where the service is indivisible and no longer useful to the customer, the relevant order is refunded in full.

No specific numerical result regarding weight, body composition or performance is guaranteed. This absence of a results guarantee does not relieve the Trader of the obligation to provide a service that conforms to the order and is performed with due diligence.

5. Price

Prices are expressed in euros and correspond to the total amounts payable.

VAT not applicable, Article 293 B of the French General Tax Code, as long as the Trader benefits from the VAT exemption threshold ("franchise en base de TVA").

Internet connection costs and personal equipment needed to use the service remain the customer's responsibility. No additional fees related to the order are added without prior notice and express acceptance.

The applicable price is the one shown when the order is confirmed. Price changes apply to new orders only.

The price of an ongoing subscription is not increased without the customer's express agreement. A later change to these Terms does not retroactively change an order already concluded.

Any discounts and their conditions are shown before purchase.

6. Order and formation of the contract

The customer:

  1. Selects the desired offer.
  2. Creates a customer account or logs in.
  3. Provides the information needed for the order and billing.
  4. Checks the summary of the offer, price and, where applicable, the subscription frequency.
  5. Corrects any errors.
  6. Accepts the Terms and, separately where necessary, expresses their choices regarding early performance.
  7. Confirms the order via a button clearly indicating the obligation to pay.
  8. Makes payment.

The order is formed once it is confirmed and payment is accepted.

The customer receives a confirmation email including the order summary, the applicable Terms on a durable medium, information on withdrawal, and any consents given for early performance.

The customer must provide accurate details and report any error to forme.nutrition2@gmail.com.

Electronic records may serve as evidence under legal conditions, without depriving the customer of the ability to provide evidence to the contrary.

For electronic contracts equal to or above the legal threshold of €120, the Trader retains them for the legal period of ten years and provides access on request, under the conditions set by applicable regulations.

7. Payment

Payments are made online through Stripe, using the payment methods offered at checkout.

One-off purchases are payable in full at the time of order.

The subscription is billed monthly according to the schedule shown at subscription.

The Trader does not retain complete banking details used for payment. Their processing is handled by the payment provider under the conditions shown during the transaction.

If the initial payment is declined, the order is not confirmed.

If a subscription payment fails, the customer is informed and invited to resolve the situation. Follow-up may only be suspended after prior notice and a reasonable period to resolve the issue. It does not result in the removal of PDFs acquired under previously and duly paid orders.

8. Delivery of programs and access to PDFs

8.1. Technical conditions

Programs are supplied as PDF files in the customer account.

Viewing them requires an Internet connection to access the site, an up-to-date browser, and a device capable of reading PDFs. Downloaded files can be viewed offline with a compatible PDF reader.

Any specific technical restriction or feature requiring an additional tool is stated on the offer's page before the order.

8.2. Ready-made programs

Ready-made programs are made available after payment is confirmed where the customer has validly requested immediate delivery under the conditions of Article 12.

Absent agreement for delivery before the withdrawal period expires, they are made available once that period ends.

8.3. Personalized programs

The customer completes the questionnaire needed for personalization after ordering.

The program is delivered no later than three business days after receipt of the completed questionnaire, subject to the customer's choice regarding early commencement of the service.

Business days are Monday to Friday, excluding public holidays in mainland France.

Where the customer has not requested early commencement, the preparation period runs from the later of two dates: receipt of the completed questionnaire, or expiry of the withdrawal period.

If essential information is missing, the Trader requests it from the customer without undue delay and informs them of the impact on the timeline. No additional payment is required to complete the information needed for the original offer.

A lack of response to the questionnaire does not, by itself, constitute a waiver of the customer's legal rights.

Delivery of the program is notified by email.

8.4. Access period

Purchased PDFs remain accessible in the customer account with no contractual time limit. Access does not depend on maintaining a follow-up subscription.

The customer can download them and keep a copy for personal use.

A technical outage does not remove the customer's rights. The Trader restores access or provides a free copy of the file by another means.

If the site permanently closes, the Trader informs affected customers with sufficient notice and arranges a way to preserve purchased content, without prejudice to legal remedies arising from the interruption of a contractually owed service.

9. Initial 30-day support

Personalized programs and the Forme & Nutrition Pack include follow-up for 30 calendar days from the delivery of the complete program.

This follow-up includes:

  • A weekly check-in for four weeks, based on information provided by the customer.
  • Exchanges through the customer account or by email.
  • Program adjustments justified by the check-ins, within the scope of the offer purchased and the Trader's expertise.

Messages are handled within a maximum of two business days. The service is not an on-call or emergency service.

The customer takes part in the check-ins and provides the information needed for follow-up. A check-in missed because the customer did not respond does not automatically extend the support period, unless otherwise agreed.

An interruption attributable to the Trader results in an equivalent extension of the follow-up or, if that is not possible or no longer useful to the customer, a refund of the unperformed service.

The initial follow-up ends without any automatic subscription and without any new charge.

10. Optional extension subscription

After the initial 30 days, the customer may separately subscribe to extended support at €19.90 per month.

This subscription requires a voluntary step and express acceptance of recurring payment. Purchasing an initial program does not amount to subscribing to this plan.

The subscription is for an indefinite term, billed monthly, with no minimum commitment beyond the current monthly period.

The follow-up start date, first payment and subsequent charges are shown before confirmation, then confirmed by email. Subsequent charges occur monthly on the anniversary date; where that date does not exist in a given month, the charge occurs on the last day of that month.

Follow-up includes the exchanges, weekly check-ins and adjustments set out in Article 9, within the scope of the program(s) concerned. An entirely new program or a separate service is included only if the offer states so.

Cancellation

The customer may request cancellation at any time, free of charge, using the cancellation feature available on the site.

A confirmation is sent on a durable medium, stating the contract's end date.

Cancellation takes effect at the end of the monthly period already paid for. A request received before the next due date prevents the next monthly charge. No additional month of notice is required.

The customer keeps follow-up until the end date and access to PDFs already acquired after cancellation.

In case of technical difficulty, the customer may send their request to forme.nutrition2@gmail.com; the date that request is received is taken into account.

A period already begun is not refunded solely because of an ordinary cancellation. This rule does not limit the right of withdrawal, statutory guarantees, or refund rights in case of non-performance.

11. Delay, non-delivery and non-performance

If a program is not received, a file is unreadable, access is impossible, or a service is not performed, the customer may contact the Trader using the details in Article 1.

For a service not performed within the agreed time, the customer may request performance within a reasonable additional period. If the Trader does not perform, the customer may terminate the contract under legal conditions.

The customer may also terminate the contract immediately where the Trader refuses to perform it or where the agreed time was an essential condition of their commitment, under conditions provided by law.

The rules specific to non-delivery of digital content and services remain applicable. Amounts owed to the customer are refunded within legal deadlines, notably within fourteen days where the law so provides.

No offer of a later date or replacement deprives the customer of their legal remedies.

12. Right of withdrawal

12.1. Period and exercise

The customer has 14 days from the formation of the contract to withdraw, without having to give a reason, subject to the exceptions described below.

The day the contract is formed is not counted. Where the period expires on a Saturday, Sunday, public or non-working holiday, it is extended to the next business day.

The customer may exercise this right:

  • Through the site's withdrawal feature, labeled "Withdraw from the contract here" or an equivalent wording.
  • By email to forme.nutrition2@gmail.com.
  • By post to Ivan PAGÈS — EI, 9 rue Romain Rolland, 13200 Arles, France.

The customer may use the attached form or any statement clearly expressing their wish to withdraw. It is enough to send this statement before the period ends.

Withdrawal made online is acknowledged on a durable medium stating its content, date and time.

12.2. Ready-made programs delivered immediately

The customer may request access to digital content without waiting for the 14-day period to expire.

The right of withdrawal is lost only if all legal conditions are met: prior express agreement to begin delivery before the period ends, express acknowledgment of the loss of the right of withdrawal, actual commencement of delivery, and confirmation of these agreements on a durable medium.

Merely accepting the Terms does not amount to consent to this loss of right.

Absent these conditions, the customer retains their right of withdrawal under legal conditions.

12.3. Personalized programs and support

The personalized nature of a program does not automatically remove the right of withdrawal.

For offers combining the preparation of a personalized program with follow-up, the Trader applies the rules on early performance of services.

The customer may expressly request that preparation and support begin before the 14-day period expires.

If the customer withdraws after the requested start of the service, only an amount proportionate to the service actually provided up to their request may be owed, in accordance with Article L. 221-25 of the French Consumer Code. The Trader provides the detail and justification of this calculation. No flat withdrawal penalty is applied.

No amount is owed for this early performance where the express request or the legally required information was not obtained or provided.

Delivery of the PDF does not amount to full performance of an offer that still includes support to be carried out.

12.4. Subscription

The initial subscription opens a 14-day withdrawal period.

If the customer requested follow-up to begin during this period and withdraws, the amount owed for that follow-up is calculated pro rata to the number of days of service provided up to the notification, relative to the number of days in the billed monthly period.

Monthly charges of the same indefinite-term subscription do not, by themselves, open a new withdrawal period.

12.5. Refund

Refundable amounts are returned no later than 14 days after receipt of the withdrawal decision, less any amount legally owed for a service already performed.

The refund uses the same payment method, unless the customer expressly agrees to another method at no cost.

Where withdrawal ends the supply of digital content, the customer stops using that content and making it available to third parties. The Trader may deactivate the relevant access.

13. Statutory guarantees for digital content and services

The Trader is bound by the statutory guarantee of conformity for digital content and services under Articles L. 224-25-1 et seq. of the French Consumer Code.

The customer may invoke it with Ivan PAGÈS — EI, 9 rue Romain Rolland, 13200 Arles, by email to forme.nutrition2@gmail.com or by phone at +33 6 13 75 09 44.

This guarantee is separate from commercial follow-up and remains applicable even without a subscription.

Box — One-off delivery of PDFs

The consumer has two years from delivery of the digital content or digital service to invoke the statutory guarantee of conformity if a defect of conformity appears. During one year from the delivery date, the consumer only needs to establish the existence of the defect of conformity, not the date it appeared.

The statutory guarantee of conformity requires the provision of all updates needed to maintain the conformity of the digital content or digital service.

The statutory guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay after their request, at no cost and without major inconvenience to them.

The consumer may obtain a price reduction while keeping the digital content or digital service, or may terminate the contract and obtain a full refund in exchange for giving up the digital content or digital service, if:

  1. The trader refuses to bring the digital content or digital service into conformity;
  2. Bringing the digital content or digital service into conformity is unjustifiably delayed;
  3. Bringing the digital content or digital service into conformity cannot happen without cost to the consumer;
  4. Bringing the digital content or digital service into conformity causes major inconvenience to the consumer;
  5. The non-conformity of the digital content or digital service persists despite the trader's unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a price reduction or termination of the contract where the defect of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to first request that the digital content or digital service be brought into conformity.

Where the defect of conformity is minor, the consumer is only entitled to cancel the contract if it does not provide for payment of a price.

Any period of unavailability of the digital content or digital service for the purpose of bringing it into conformity suspends the guarantee remaining until the digital content or digital service is supplied again in conformity.

The rights mentioned above arise from Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.

A trader who, in bad faith, obstructs the implementation of the statutory guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 242-18-1 of the French Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction while keeping the digital content or digital service, or a full refund in exchange for giving it up.

Box — Digital services supplied on a continuous basis

This box concerns digital features supplied continuously: access to content in the customer account with no contractual time limit and, where included in the offer, digital follow-up features during the initial 30 days or throughout the subscription.

The consumer is entitled to the statutory guarantee of conformity if a defect of conformity appears at any time during the contractual period the digital service is supplied, as described above, from its supply. During this period, the consumer only needs to establish the existence of the defect of conformity, not the date it appeared.

The statutory guarantee of conformity requires the provision of all updates needed to maintain conformity throughout this contractual period.

  1. The trader refuses to bring the digital content or digital service into conformity;
  2. Bringing the digital content or digital service into conformity is unjustifiably delayed;
  3. Bringing the digital content or digital service into conformity cannot happen without cost to the consumer;
  4. Bringing the digital content or digital service into conformity causes major inconvenience to the consumer;

These rights arise from Articles L.

14. Precautions and liability

The customer provides accurate, relevant and up-to-date information to allow the program and follow-up to be carried out.

The customer uses the programs in a way that reflects their abilities and safety guidance. In case of unusual pain, feeling unwell or a concerning symptom, they stop the exercise and seek the advice of a healthcare professional.

A medical condition, injury, pregnancy, eating disorder, or any other situation requiring medical adaptation should lead to an assessment by a healthcare professional before using a program that could be unsuitable.

The Trader remains liable for breaches attributable to it, under applicable law. These precautions do not constitute a waiver of liability.

No clause limits the rights arising from statutory guarantees or liability where such a limitation is prohibited.

15. Customer account and security

The customer keeps their login details confidential and informs the Trader of any unauthorized use they become aware of.

The Trader takes appropriate measures to secure access to the service. In the event of a proven security breach, a strictly necessary temporary restriction may be put in place, with the customer informed and access restored as soon as possible.

Maintenance or a security measure does not deprive the customer of their rights in case of unavailability or non-performance.

16. Intellectual property

The programs, texts, illustrations and materials supplied are protected by applicable intellectual property rights.

The purchase grants the customer a personal, non-exclusive, non-commercial right of use. They may download the PDFs, keep them and print them for their own needs.

Except with written permission or a legal exception, reselling, publishing, distributing to third parties, making them collectively available, or commercial exploitation is prohibited.

These restrictions do not prevent uses authorized by law nor the sharing of documents necessary for the customer to exercise their rights with an advisor, a mediator or a court.

17. Personal data

Ivan PAGÈS is responsible for the data processing needed to manage orders, billing, delivery of programs and support.

Detailed information on purposes, legal bases, recipients, retention periods and individual rights appears in the privacy policy available on the site and in the information presented at the time of collection.

Only data necessary for the service is requested. Health-related information is subject to the specific protections and processing conditions set by applicable regulations.

Where explicit consent is required for processing, it is collected separately. Accepting the Terms does not, by itself, amount to consent to the processing of health data or to marketing.

The customer may exercise their rights by writing to forme.nutrition2@gmail.com. They may also contact the French data protection authority (CNIL) at www.cnil.fr.

18. Complaints and consumer mediation

The customer may send any complaint:

  • By email: forme.nutrition2@gmail.com.
  • By post: Ivan PAGÈS — EI, 9 rue Romain Rolland, 13200 Arles, France.

The customer is asked to state their identity, the order concerned and the purpose of their request. Supporting documents help processing without being an additional condition to exercising their rights.

After a prior written complaint that did not lead to a satisfactory solution, the customer may use, free of charge, the consumer mediator the Trader falls under:

Centre de la Médiation de la Consommation de Conciliateurs de Justice — CM2C
49 rue de Ponthieu, 75008 Paris, France
Website: www.cm2c.net

The request must notably be submitted within a maximum of one year from the written complaint sent to the Trader, must not be clearly unfounded or abusive, and must not concern a dispute already examined or being examined by another mediator or a court. Other legal admissibility conditions apply.

Mediation is optional for the consumer. It does not prevent them from bringing the matter before the competent court.

19. Governing law and dispute resolution

These Terms are governed by French law.

Where the customer habitually resides in another country, this choice does not deprive them of the mandatory protective provisions they benefit from where those apply to the contract.

Disputes fall under the competent courts in accordance with applicable legal rules. No exclusive jurisdiction in favor of the courts of the Trader's place of business is imposed on the consumer.

If a clause is found unenforceable, the other provisions remain applicable to the extent permitted by law.
